Service Terms and Conditions for Rubbish Removal Wimbledon

These Terms and Conditions set out the basis on which Rubbish Removal Wimbledon provides waste and rubbish removal services. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions and Interpretation

In these Terms and Conditions, the following expressions shall have the meanings set out below:

Customer means the person, business, or organisation booking rubbish removal services.

Company means Rubbish Removal Wimbledon, which provides the waste collection and disposal services.

Services means any waste removal, rubbish clearance, bulky item collection, or associated activity carried out by the Company.

Waste means the items, goods, materials, or rubbish presented by the Customer for collection and disposal as part of the Services.

Contract means the agreement between the Customer and the Company for the provision of Services, formed in accordance with these Terms and Conditions.

2. Scope of Services

The Company provides rubbish removal, waste collection, and related clearance services for domestic and commercial Customers. The exact nature and scope of the Services will be as agreed at the time of booking, based on the information provided by the Customer regarding the type, volume, and location of Waste.

The Company reserves the right to refuse to remove any Waste that is hazardous, prohibited by law, unsafe to handle, or significantly different from that described at the time of booking. In such cases, additional charges may apply if the crew has already attended the site.

3. Booking Process

3.1 The Customer may request a quotation and book Services by telephone, email, or any other method made available by the Company from time to time.

3.2 At the time of booking, the Customer must provide accurate details of:

a. The type and approximate quantity or volume of Waste.

b. The collection address and access details.

c. Any restrictions, parking limitations, or special requirements that may affect the Company’s ability to provide the Services.

3.3 Any quotation given prior to collection is based on the information supplied by the Customer and is an estimate only. The final price may be adjusted on site if the actual Waste volume, weight, or type differs from that described, or if access is more difficult than stated.

3.4 A booking is considered accepted, and a Contract formed, when the Company confirms the booking and provides a time window for collection. The Company will use reasonable efforts to attend within the agreed time window but does not guarantee exact arrival times.

4. Access and Parking

The Customer is responsible for ensuring safe, reasonable, and lawful access to the collection address, including adequate parking or stopping space for the removal vehicle. If parking charges, permits, or fines are incurred due to inadequate arrangements by the Customer, these may be charged to the Customer in addition to the Service fee.

If the Company is unable to carry out the Services due to lack of access, unsafe conditions, or parking restrictions not previously disclosed, the Company may treat the visit as a failed collection and apply a call-out or cancellation fee.

5. Customer Responsibilities

The Customer agrees to:

a. Ensure they have the legal right, ownership, or authority to dispose of the Waste presented.

b. Separate, where applicable, any items that are hazardous, restricted, or require special handling, and disclose these to the Company in advance.

c. Provide clear instructions as to which items are to be removed and which items are to remain.

d. Ensure that access routes are reasonably clear and safe for the Company’s staff to carry out the Services.

e. Supervise the collection where necessary and sign any job completion or waste transfer documentation provided.

The Company will not be liable for removing items it reasonably believed to be Waste based on the Customer’s instructions and the circumstances at the time.

6. Payments and Charges

6.1 The price for the Services will be as agreed at the time of booking or as adjusted on site following an assessment by the Company’s representative.

6.2 Unless agreed otherwise in writing, payment is due immediately upon completion of the Services. The Company may require payment in advance or a deposit for certain bookings, especially large or commercial clearances.

6.3 The Company accepts payment methods as advised at the time of booking, which may include cash, debit or credit card, or bank transfer. Cheques may only be accepted by prior agreement.

6.4 For commercial Customers with credit accounts, invoices will be payable within the payment terms set out on the invoice. The Company reserves the right to charge interest on overdue sums at the statutory rate.

6.5 All charges are inclusive or exclusive of VAT as specified at the time of booking. Any additional costs such as parking, congestion, or specific disposal fees will be notified to the Customer where reasonably practicable.

7. Cancellations, Amendments, and Failed Collections

7.1 The Customer may cancel or amend a booking by contacting the Company during its normal working hours.

7.2 If the Customer cancels more than 24 hours before the agreed collection time, no cancellation fee will usually be charged, unless specific costs have already been incurred by the Company.

7.3 If the Customer cancels less than 24 hours before the collection time, or if the Company attends the address and is unable to complete the Services due to reasons within the Customer’s control, the Company may charge a reasonable cancellation or call-out fee.

7.4 The Company reserves the right to cancel or reschedule a booking at any time for reasons including, but not limited to, staff availability, vehicle breakdown, adverse weather conditions, safety concerns, or other circumstances beyond its reasonable control. In such cases, the Company will endeavour to notify the Customer as soon as practicable and offer an alternative time or a refund of any pre-paid sums for Services not provided.

8. Waste Regulations and Compliance

8.1 The Company operates in accordance with applicable UK waste management legislation and guidance, including duties relating to the safe and lawful handling, transport, and disposal of Waste.

8.2 The Company will take reasonable steps to ensure that Waste is transferred only to licensed or appropriately authorised facilities and that all necessary documentation is completed where required.

8.3 The Customer acknowledges their duty of care under relevant waste regulations to ensure that Waste is transferred only to a responsible carrier. By engaging the Company, the Customer confirms that they are seeking a lawful and compliant route for their Waste.

8.4 Certain types of Waste, such as hazardous materials, chemicals, asbestos, clinical waste, or electrical items requiring specialist treatment, may be subject to additional charges or may not be accepted. The Customer must disclose such Waste at the time of booking. The Company reserves the right to refuse to handle such items if they have not been previously agreed in writing.

9. Title and Risk in Waste

Ownership of the Waste transfers to the Company at the point where the Waste is loaded onto the Company’s vehicle, provided that the Customer has the legal right to dispose of the Waste. From that moment, risk and responsibility for the Waste passes to the Company, subject to compliance with applicable laws and regulations.

If it is subsequently discovered that the Customer did not have the right to dispose of particular items, the Customer shall indemnify the Company against any resulting claims, losses, or costs.

10. Damage, Liability, and Limitations

10.1 The Company will take reasonable care when carrying out the Services. However, the Customer should ensure that any fragile or valuable items are removed or clearly identified prior to the collection.

10.2 The Company shall not be liable for:

a. Normal wear, tear, or minor scuffs to walls, floors, or paths arising from the reasonable movement of Waste.

b. Damage resulting from pre-existing defects, inadequate construction, or unsafe conditions at the property.

c. Loss or damage to items that the Company was not instructed to remove but which were reasonably considered to be Waste.

10.3 To the fullest extent permitted by law, the Company’s total liability to the Customer arising under or in connection with the Contract, whether in contract, tort, or otherwise, shall be limited to the total amount paid or payable by the Customer for the specific Services giving rise to the claim.

10.4 Nothing in these Terms and Conditions shall limit or exclude liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.

11. Delays and Events Beyond Our Control

The Company shall not be responsible for any delay or failure to perform the Services due to events beyond its reasonable control, including but not limited to severe weather, traffic congestion, accidents, vehicle breakdown, industrial action, or civil disturbances.

Where such events occur, the Company will use reasonable endeavours to minimise disruption and reschedule the Services where possible.

12. Insurance

The Company maintains appropriate insurance cover in respect of its operations, including public liability insurance. Details of such insurance can be provided on request. The Customer is advised to maintain their own insurance for their property and contents.

13. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they should notify the Company as soon as possible, providing full details of the issue. The Company will investigate the complaint and aim to resolve it promptly and fairly.

If a dispute cannot be resolved directly between the parties, either party may pursue any remedies available under English law.

14. Data Protection and Privacy

The Company may collect and process personal data about the Customer for the purposes of managing bookings, providing Services, processing payments, and maintaining records.

The Company will handle such personal data in accordance with applicable data protection laws and keep it secure. The Customer’s information will not be sold to third parties. It may be shared with service providers where necessary to fulfil the Services or comply with legal obligations.

15. Variation of Terms

The Company reserves the right to amend or update these Terms and Conditions from time to time. Any changes will generally apply to new bookings made after the date of publication. The Terms and Conditions current at the time of the Customer’s booking will govern the Contract for those particular Services, unless otherwise agreed in writing.

16. Severability

If any provision of these Terms and Conditions is found to be invalid, unlawful, or unenforceable by a court or competent authority, such provision shall be deemed modified to the minimum extent necessary to make it valid and enforceable, and the remaining provisions shall continue in full force and effect.

17. Entire Agreement

These Terms and Conditions, together with any written quotation or confirmation of booking, constitute the entire agreement between the Customer and the Company in relation to the Services and supersede any prior communications, representations, or agreements, whether oral or written.

18. Governing Law and Jurisdiction

These Terms and Conditions and any dispute or claim arising out of or in connection with them, or with the provision of rubbish removal and waste collection Services by the Company, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising from or related to these Terms and Conditions or the Services provided.

By placing a booking with Rubbish Removal Wimbledon, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
